By downloading, installing, or using the SmokeFree Journey application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not use the App.

Important: SmokeFree is a motivational and tracking tool only. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

The health milestone information presented in the App is based on general scientific research about smoking cessation recovery. Individual results may vary significantly based on personal health history, duration and intensity of smoking, and other factors.

Always consult with a qualified healthcare provider before making any decisions about your health, including decisions to quit smoking, especially if you have underlying health conditions or are taking medications.

In-App Purchases

SmokeFree offers optional Pro features through in-app purchases:

All purchases are processed through Apple's App Store. By making a purchase, you agree to Apple's terms and conditions for in-app purchases.

Subscription Terms: Monthly subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your App Store account settings.

Refunds: All purchases are handled by Apple. For refund requests, please contact Apple Support or visit reportaproblem.apple.com.

Intellectual Property

The SmokeFree app, including its design, features, content, and code, is owned by LotriFlow and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we handle your information. By using SmokeFree, you consent to our privacy practices.

Limitation of Liability

To the maximum extent permitted by law, LotriFlow and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the App or Pro features in the 12 months preceding the claim.

Disclaimer of Warranties

SmokeFree is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or secure, or that any defects will be corrected.

Changes to the App

We reserve the right to modify, suspend, or discontinue any aspect of SmokeFree at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the modified Terms.

Termination

You may stop using SmokeFree at any time by deleting the App from your device. We reserve the right to terminate or suspend access to the App for users who violate these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.
